Update: September 2023
 
Following an announcement by the Government on Tuesday 29th August we have updated our webpage to make you aware of some proposed changes regarding Nutrient Neutrality. A letter dated 1st September from the DLUHC Chief Planner to the LPA Chief Planners, which sets out the proposed changes can be seen here.

 

Please note that these changes have not been implemented, so we have retained the existing information regarding Nutrient Neutrality on this webpage. The proposed changes are subject to Parliamentary scrutiny and process, so until such time as the changes come into force developers are expected to continue to source mitigation credits and work within the existing legal framework.

 

Anglian Water will continue to work within the Norfolk Joint Venture and provide further updates when information becomes available.

A letter from Natural England was issued to authorities whose areas contain habitat sites that are in an unfavourable conservation status, where additional nutrient loads, such as from development, may have an adverse effect. This advice states that planning applications and plans affecting such habitats should be carefully considered and mitigation provided to ensure there are no adverse effects and to meet the requirements of the Conservation of Species and Habitats Regulations 2017 (as amended).


Within the Anglian Water area of operation this includes developments within the Norfolk local authority areas.
